Terms of Service
This policy outlines the terms of service under which Usual Digital Agency applies to all projects and our responsibilities in such situations. By engaging our services, you agree to these terms and conditions.
Information Use.
The information we collect is used to improve our website's content, update clients about website changes, or resolve issues with requests. If you wish not to receive emails from us, please let us know via email.
Confidentiality.
Usual Digital Agency commits to maintaining the confidentiality of all client information obtained during the course of a project. Information will not be disclosed to any third party without the client's written consent, except as required by law.
Limitation of Services.
Our services are confined to the scope outlined in the client agreement. Any additional services not detailed in this scope may incur additional charges.
Limitation of Liability.
Our liability is limited to the value of the incomplete project portion. We are not liable for losses due to provided/delayed services. Refund eligibility is only valid if the project is cancelled by the client and communicated in writing.
Amendments to Services.
Any changes to the scope or nature of the project must be agreed upon in writing by both parties. Adjustments may result in changes to fees and delivery timelines.
Coverage & Scope.
Our refund policy applies to refunds by Usual Digital Agency and any website owned and managed by us. It does not apply to third-party companies or individuals not managed by Usual Digital Agency, including third-party service/product providers and external websites linked to ours.
Payment Terms.
Payment terms will be as per the agreement with the client, usually requiring a deposit with the balance payable upon completion. Late payments may be subject to interest and fees as per the Late Payment of Commercial Debts (Interest) Act 1998.
Client Responsibilities.
The client is responsible for providing Usual Digital Agency with all necessary access to information, materials, and resources as needed for the completion of the project. Failure to do so in a timely manner may affect project completion and delivery.
Intellectual Property Rights.
All intellectual property rights in materials produced as a result of our services will be the property of Usual Digital Agency until payment is received in full, at which point they will become the property of the client. This includes, but is not limited to, designs, code, and documentation.
Project Cancellation Policy.
Either party may cancel a project with 30 days written notice. Clients are responsible for any costs incurred up to the point of cancellation. Cancellation terms may vary depending on the specific agreement with the client.
Dispute Resolution.
In the event of a dispute, both parties agree to first attempt to resolve the disagreement through direct negotiation. If a resolution cannot be reached, mediation must be pursued before any legal action is taken. All mediation costs will be applied at the discretion of the appointed mediator.
Filing a Complaint.
At Usual Digital Agency, we view each project as a mutual commitment. We believe in striving for solutions that satisfy both parties. Should a situation arise where you consider a refund, we encourage you to first contact us at letstalk@usual.ie for a final discussion before filing a claim. Refunds should be considered only when all other options have been exhausted.
Eligibility for Refund.
Every project at Usual Digital Agency is treated with utmost care. If, despite our efforts, you are dissatisfied and opt for dispute resolution, we will consider refund requests as follows:
Website & Graphic Design:
Full refund: If the project hasn't started or if the initial design style has not passed the full site layout or testing site stage. The full refund process will commence after receiving the initial upfront payment and will take 180 days.
Partial refund: In case of failure to deliver as per our policy after the initial design style has passed the full site layout or testing site stage. The refund will be proportional to the work completed.
No refunds: If the project is completed, live and uploaded to the server.
Web Programming:
Full refund: If the project hasn't been initiated.
Partial refund: As per our judgement, if we fail to complete the project as per the delivery policy and contract agreement.
Dedicated Hiring:
Full refund: If no work has been initiated by our team.
Proportionate refund: Based on the work completed until order cancellation.
No refund: For services already provided. Issues must be reported immediately to our project manager.
Applicability of the Delivery Policy.
Projects are not considered void unless agreed payments are clear.
Refund policy is void if project delays/failures are due to poor communication from the client.
No compensation for delivery delays unless a penalty clause is included in the signed agreement.
Processing of Refunds.
Partial refunds are processed within 180 business days of cancellation, using the original method of payment.
Full refunds are processed within 50 business days of cancellation, using the original method of payment.
Force Majeure.
Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party.
Changes.
Usual Digital Agency may amend this policy at any time without prior notice. We encourage you to review this policy periodically. Continued use of our website and services implies acceptance of any amendments unless specific project contract terms apply.
Governing Law and Jurisdiction.
These terms and conditions and any disputes or claims arising out of or in connection with them are governed by and construed in accordance with the laws of the Republic of Ireland. The courts of Ireland will have exclusive jurisdiction to settle any dispute or claim.
